Subject to your compliance with these terms and conditions of use, we grant you a personal, non-exclusive, non- transferable, limited right to access, use, display and download, the GINGER CHEF LLC, online service for noncommercial purpose only. You may view, display, copy, download and print the material for your own personal noncommercial use. All copyright, trademark and other proprietary notices contained in the materials must be retained on all copies thereof. SECTION 1 – MEALS ONLINE ORDERING

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

GINGER CHEF LLC, offers meal prep services, our meal are fresh and chef cooked, you can order weekly healthy meals and we will deliver them; you will create and account for reordering purposes, GINGER CHEF LLC will not sell your personal information.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us GINGER CHEF LLC.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 – IMPORTANT HEALTH AND ALLERGENS INFORMATION

GINGER CHEF LLC can not guarantee that meals prepared in our kitchen will not be crossed contaminated with known food allergens, we care about our costumers and take food allergens very serious. Note that while most of our meals are gluten free and don’t contain milk, we may use son derivates of these ingredients, such as cheese and butter, we also may wheat, three nut, peanuts and fish; if you do have mild to severe allergies, GINGER CHEF LLC may not be for you, if you do purchase any of our products is under your responsibility.

HEALTH AND NUTRITIONT. The meals prepared and diet suggestions on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting your primary care physician for more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.

Is important to consult with your primary care physician, if you do have any health conditions such as diabetes, high-low cholesterol, any heart condition, etc, also if you’re pregnant or in post operation or specific diet, please consult with different sources before purchasing any meal suggestion from GINGER CHEF LLC, do not rely in any nutrition facts.

GINGER CHEF LLC meals are designed for healthy adult individuals without any specific health needs. While the meals prepared at GINGER CHEF are fresh, organic, and healthy, we do not rely on this to provide this service to people with serious health conditions.

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 4 – PAYMENT, MODIFICATIONS TO THE SERVICE AND PRICES

You are responsible for payment of your order, by means of a payment option available through GINGER CHEF LLC online services at the time of ordering, before you summit an order you must provide a valid form of accepted payment to use with your order, GINGER CHEF LLC will charge, and you authorize GINGER CHEF LLC to charge, the payment method you specify at the time you place the order. GINGER CHEF LLC, reserves the right to seek pre-authorization of your payment card account, prior to final purchase to verify the payment card is valid.

We will collect applicable sales tax on Products shipped to the states for which we determine we have a duty to collect sales tax. If an item is subject to sales tax, you agree that the amount of taxes shown at checkout may be adjusted. Several factors may cause this, such as variances between processor programs and changes in tax rates. Prices for our products are subject to change without notice.

All prices are shown in U.S. dollars and applicable taxes and other charges, if any, are additional. We reserve the right to adjust prices as we may determine in our sole discretion, at any time and without notice. We will not, however, be able to notify you of changes in any applicable taxes.

We reserve the right at any time to modify or discontinue the Service without notice at any time.We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5- DELIVERIES, SHIPPING AND HANDLING

You are responsible for inspecting all products you receive from us at the time of delivery and handling, GINGER CHEF LLC do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure or error or damage free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

To maintain the quality and integrity of the Products, we recommend that you immediately refrigerate all perishable Products upon delivery and follow the U.S. Department of Agriculture’s (“USDA”) instructions on refrigeration and food safety. We recommend that you follow the USDA’s instructions on safe food handling. We also recommend that you use a food thermometer to ensure that all meat, poultry, seafood, and other applicable items are cooked to the USDA’s recommended internal temperatures, Failure to follow safe food handling practices and temperature recommendations may increase the risk of foodborne illness. In addition, pregnant women, young children, the elderly, and individuals with compromised immune systems should follow the U.S. Food and Drug Administration’s recommendations on food consumption for at-risk groups.

You understand that by ordering from GINGER CHEF LLC, If you are not at home when your meal delivery arrives, you are responsible if the food isn’t in perfect condition due to abandoned package outside, the courier will generally leave the package at your door but depending on the season and temperature in your geographic area at the time of delivery, advance planning by you should be made for immediate and proper storage of your meal or product prior to consumption. Any individual at the delivery address who accepts a delivery from us is presumed to be authorized to receive such delivery. In cases in which you have designated an alternative receiver, such person shall accept the delivery under all of the same terms and conditions that would apply had you accepted the delivery yourself.

In the case of inclement weather or other events beyond our control that interfere with our ability to deliver your Order, we will attempt to deliver your Order as soon as reasonably possible. In some cases, delivery may occur prior to the scheduled delivery date. If timely delivery of your Product is not feasible, we will cancel your delivery for the period so affected and issue you a Credit or refund of the purchase price for that delivery.

If you have and issue receiving your order the day you chose, please give a 48 hour notice to switch the delivery day.

You agree to pay any shipping and handling charges shown at the time you make a purchase. GINGER CHEF LLC reserve the right to increase, decrease, add, or eliminate shipping and handling charges from time to time, but we will provide notice of the charges applicable to you before you make your purchase. Any shipping times shown on the Sites are estimates only. Actual delivery dates may vary. You agree that you will not obtain, or direct shipment of, a Product for export.

All of your meals will be delivered Wednesdays and Sundays, from 7:00am to 7:00 pm, with no time slot. You can place an order 48 hours before our delivery days.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

SECTION 6– CANCELATIONS, CHANGE AND MEALS REORDER

GINGER CHEF LLC , sells fresh meals delivery to your door, cooked by a professional chef; The number of meals you receive is based of how many you Order or Reorder, and the amount you are charged at WWW.HELLOGINGERCHEF.COM may vary from week to week depending on any specials that may change or price adjustments done by us. Changes to your Order’s or other choices you may make (such as the number of meals you receive, delivery options, add-ons and more), may also result in changes to any applicable shipping and handling charges and meal delivery times. Note that we do not currently deliver meals to every location, so please visit our website page to see if we deliver to your area.

Please, read return or exchange if need to make any change in your meals after placing your order.

SECTION 7– SUBSCRIPTION PLANS, PAYMENTS AND CANCELLATIONS

By agreeing, subscribing and purchasing any of our plans at GINGER CHEF LLC, you will get weekly deliveries with the amount of meals you purchased through our website WWW.HELLOGINGERCHEF.COM, they will be randomly selected by our chef, the meals may vary from week to week depending on any specials. (please read section number 3 for allergens information). the plan that you have purchased will be automatically charged weekly until cancellation.Please see section number 5 for delivery information.

If your plan was charged and you need to cancel GINGER CHEF LLC, reserved the right to not to offer cancelations or return over this order, and your order will still be delivered. Please contact shurpal@hellogingerchef.com for more help.

SECTION 8- RETURN OR EXCHANGE

Certain products or services such meal plans or non plan may be available exclusively online through the website. These products or services may have limited quantities and they are not subject to return while you can still exchange some of the meals during the 24 hour window after placing the order and depending availability of the product, noted prices may be affected with the meals exchanging and the costumer has to be responsible of the extra charge, according to our Return and exchange Policy. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 9 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

GINGER CHEF LLC reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.
